En este ensayo, argumento las razones por las cuales hay que considerar algunas obras del sociólogo colombiano Orlando Fals Borda, como una “teoría crítica contemporánea” que pretende hacer, ver y poner al descubierto algunas problemáticas que giran en torno al elevado aprecio por el conocimiento científico europeo y norteamericano, para el autor no siempre este conocimiento es el más pertinente para explicar y comprender las realidades sociales, culturales y naturales de las sociedades latinoamericanas como la colombiana, por ende, la fundamentación.

In order to clarify whether Rawls is more or less cosmopolitan than Kant, we carry out a comparative analysis between his general proposals for the organization of international relations. Likewise, seeking to clarify the distance between cosmopolitanism, pacifism and ius internationalism, the ius ad bellum proposals of both authors are particularly analyzed in the war-and-peace debate context. On the one hand, as a result of the first analysis, different commonly unnoticed logical coincidences between the postulates of Kant and Rawls are (...) highlighted. On the other hand, after the conclusions of the second analysis and taking as a criterion the causes that both authors admit as just for war, a proposal of an ideal type of cosmopolitan ius ad bellum is also provided. The aim of the present study is to analyze individual differences in academic self-efficacy within a population of Unaccompanied Foreign Minors from the European cities of Ceuta and Melilla. Variables describing educational level and length of stay were considered in a sample of 377 individuals being cared for in different youth centers. Of these, 63.4% belonged to the group who had stayed at the center for less than 9 months and 36.6% reported a length of stay of more than 9 (...) months. The age of participants ranged between 8 and 17 years old. Once the quality parameters of the instrument were elaborated, reliability and validity was confirmed through Confirmatory Factor Analysis using Structural Equation Modeling methodology. Data collection was then initiated. The results overall indicate that 87.6% of those who completed the questionnaire reported a higher level of self-efficacy with regards to working with any classmate, whilst at the same time seeing themselves as capable of achieving good marks. ANOVA results indicated significant differences with respect to educational level and length of stay. In this regard, students who had received professional training and had been at the Center for more than 9 months, were the ones who developed greater academic self-efficacy for spending more time working when tasks were judged to be difficult. The results obtained demonstrate that any intervention will be positive as long as it promotes different institutions to develop strategies that cater to a length of stay of more than 9 months and target education, academic self-efficacy, socialization and strengthening the future workforce. Such interventions can be directed through new European, Spanish or local level policies. It is clear that institutions still have a lot of work left to do. (shrink)

Sally Haslanger is concerned with the debate between social constructionists and error theorists about a given category, such as race or gender. For example, social constructionists about race claim that the term “race” refers to a social kind, whereas error theorists claim that the term “race” is an empty term, that is, nothing belongs to this category. It seems that this debate depends in part on the meaning of the corresponding expression, and this, according to some theorists, depends in turn (...) on our intuitions as competent speakers. But then, what should we say if competent users of the expressions “race” and “gender” understand the terms so that being a natural or biological property is a necessary condition in order to fall under the term? If that were the case, then it would seem that a social constructionist view would be out of the question. Haslanger has argued that a social constructionist view could still be defended in that situation. In order to argue for this, she draws on the classical arguments for semantic externalism, which show that the intuitions of competent speakers concerning the nature of a given category, and the objective type that actually unifies the instances of that category, may come apart. In this paper I will argue that the arguments for semantic externalism concerning natural kinds do not really offer support for Haslanger’s claim that ordinary intuitions concerning social kinds are not relevant. In this paper, I focus on an influential account of phenomenal concepts, the recognitional account, and defend it from some recent challenges. According to this account, phenomenal concepts are recognitional concepts that we use when we recognize experiences as “another one of those.” Michael Tye has argued that this account is viciously circular because the relevant recognitional abilities involve descriptions of the form “another experience of the same type,” which is also a phenomenal concept. Tye argues that we avoid the (...) circularity worry if we explain the reference-fixing of phenomenal concepts in terms of dispositions to re-identify tokens of the same type without appealing to any further phenomenal concepts. However, he argues, this account is incompatible with the intuitive claim that phenomenal concepts seem to involve rich modes of presentation of their referents. Philip Goff and others have similarly argued that a recognitional account of phenomenal concepts would make phenomenal concepts opaque, that is, unable to reveal anything about their referents, which seems problematic. In this paper, I present a new version of the recognitional account that avoids the circularity worry without entailing that phenomenal concepts are opaque. (shrink)

The goal of responsible engineers is the creation of useful and safe technological products and commitment to public health, while respecting the autonomy of the clients and the public. Because engineers often face moral dilemma to resolve such issues, different engineers have chosen different course of actions depending on their respective moral value orientations. Islam provides a value-based mechanism rooted in the Maqasid al-Shari‘ah (the objectives of Islamic law). This mechanism prioritizes some values over others and could help resolve the (...) moral dilemmas faced in engineering. This paper introduces the Islamic interpretive-evaluative maxims to two core issues in engineering ethics: genetically modified foods and whistleblowing. The study aims primarily to provide problem-solving maxims within the Maqasid al-Shari‘ah matrix through which such moral dilemmas in science and engineering could be studied and resolved. (shrink)

The oil industry has played a major role in the economy of modern Iran and Malaysia, especially as a source of transnational exchange and as a major factor in industrial and urban development. During the previous century, the arrival of oil companies in the Persian Gulf, brought many changes to the physical built environment and accelerated the urbanization process in the port cities. Similarly, the development of the national oil industry had a huge impact on post-independence Malaysia, affecting balance sheets, (...) the environment, and society. Oil significantly changed Malaysia’s position in the global economy and transformed a predominantly agricultural country into a major producer of petroleum and natural gas. Through implementing the analytical, historical and comparative perspectives, this paper focuses on the legacy of oil cities in the Persian Gulf and the South China Sea as the birthplaces of the oil industry in two regions, whose geopolitical importance along with oil’s historical significance has the potential for representing national unity, political memory and collective shared identity. In proposing this grounding, the paper seeks to approach the heritage of oil as a particular form of industrial heritage. This research analyses the future of energy heritage, existing Covid-related challenges, political tensions and examines the various impacts, transitions and capacities associated with the current international relations, post-pandemic urban developments, and the post-oil future to pave the way to these nascent areas of industrial heritage and oil heritage in Iran and Malaysia. An extensive work has been done on corporate social responsibly practices that mainly emphasized the larger firms within developed nations. Nonetheless, still work is needed to observe the importance of CSRPs’ and ethical cultural practices in terms of sustainable competitive performance that garnered far less attention by the existing literature. This study explores the impact of CSRPs on SACP with the mediating role of ECL from SMEs of two emerging nations, i.e., China and Pakistan based on stakeholders’ theory and practices. (...) The results using SEM affirmed the positive linkages of CSRPs—environment responsibility, community responsibility, customers' responsibility, suppliers responsibility, employee responsibility, and Govt. rules & regulations’ responsibility —on SACP. It found that CSRPs have positive relationships with ECL whereas ECL further positively correlated with SACP in the context of both countries. The findings revealed the positive mediating influence of ECL between CSRPs and SACP, respectively. This study furnishes insightful information for management on how firms may achieve sustainable performance by incorporating ethical cultural practices and corporate social responsibility practices as the strategic tools. This paper makes the claim that the overall structure of Plato’s Laws follows the principle of indirect access to the knowledge of human soul, which consists in the understanding that a philosophical approach to the soul is only possible initially through an image of it. The structure of the Laws can be interpreted as a movement towards the soul’s interior, beginning with the famous image of the puppet. According to this image, the movement opens with the analysis of the non-rational (...) elements of the soul, which are capable of an harmonic relation with the rational element, and advances bit to bit to the rational or epistemic element. The political necessity of undertaking the dialectical investigation in order to attain a philosophical knowledge of the human soul and its specific excellence appears only at the end of the dialogue. In this way, the structure of the Laws dramatizes the progressive birth of philosophy, conceived as the dialectical investigation of the unity of virtue, starting from the initial understanding of the human soul contained in the myth of the puppet. This paper argues that there is a thread in the philosophy of E. Tugendhat binding together his moral and justice theories with his conceptual analysis. Oriented by the thesis that a conceptual analysis is necessary to explain what justice is, this paper reconstructs some aspects of Tugendhat’s philosophy. It is divided in four sections: First, I delve into the author’s definition and use of conceptual analysis. Second, I describe some features of Tugendhat’s moral theory of contractualism. Third, I examine his (...) theory of justice. Fourth, I conclude by framing my analysis within the debate between Rawls’s and Tugendhat’s theories of justice. (shrink)

The past decade has seen an explosion of work on calculi of explicit substitutions. Numerous works have illustrated the usefulness of these calculi for practical notions like the implementation of typed functional programming languages and higher order proof assistants. It has also been shown that eta-reduction is useful for adapting substitution calculi for practical problems like higher order unification. This paper concentrates on rewrite rules for eta-reduction in three different styles of explicit substitution calculi: λσ, λse and the suspension calculus. (...) Both λσ and λse when extended with eta-reduction rules, have proved useful for solving higher order unification. We enlarge the suspension calculus with an adequate eta-reduction rule which we show to preserve termination and confluence of the associated substitution calculus and to correspond to the eta rules of the other two calculi. We prove that λσ and λse as well as λσ and the suspension calculus are non-comparable while λse is more adequate than the suspension calculus in simulating one-step beta-reduction. After defining the eta-reduction rule in the suspension calculus, and after comparing these three calculi of explicit substitutions , we then concentrate on the implementation of the rewrite rules of eta-reduction in these calculi. We note that it is usual practice when implementing the eta rule for substitution calculi, to mix isolated applications of eta-reduction with the application of other rules of the corresponding substitution calculi. The main disadvantage of this practice is that the eta rewrite rules so obtained are unclean because they have an operational semantics different from that of the eta-reduction of the λ-calculus. For the three calculi in question enlarged with adequate eta rules we show how to implement these eta rules. For the λse we build a clean implementation of the eta rule and we prove that it is not possible to follow the same approach for the λσ and λsusp. (shrink)

The present study was conducted as part of a larger study that aimed to compare moral judgment competence and moral preferences among Pakistani students of public and private sector educational institutes and religious institutes and also to measure the pattern of development of moral judgment competence of students within these institutes. The validation study completed in two phases, during the 1st phase data were collected from the students of grade 8 to 16 from public sector schools and colleges of Rawalpindi (...) city. Very low mean c-score was observed, the test came out to be valid on preference hierarchy criterion but its validity on the cognitive-affective parallelism and Quasi- simplex structure criteria could not be established due to low c-scores of the sample. In the second phase an additional sample from one private sector and two public sector universities was collected. The analysis of the combined sample showed no significant improvement of c-scores. The test meets well the preference hierarchy criterion but on the other two criteria results remain inconclusive due to low variance in the sample. The low c-scores are explained on the basis of three assumptions; poor quality of education, dogmatic religiosity, and weak and instable political structure of Pakistani society. (shrink)

Criticism of Nurcholish Majid's thoughts on Islamic reform.

Two sample populations, one refugee and one resident, were studied. The frequencies of consanguineous marriages came out to be 49·8% and 55·4%, respectively, for the refugees and the residents. Caste endogamy was dominant both in the residents and the refugees. The mean coefficient of inbreeding was calculated to be 0·0303 for the refugee population and 0·0332 for the resident population samples. First cousin marriage was the dominant type of marriage in both samples; fathers daughter (FBD) marriage was more frequent among (...) the refugees while mothers daughter (MBD) marriage was more frequent among the residents. Education has no decreasing effect on the incidence of consanguineous marriages. A significant difference in the pattern of marriages in the refugees is observed after the Saur Revolution of 1979. Se explora la relación entre las dimensiones proposicional y no proposicional de la creencia religiosa para mostrar que la última dirige el proceso de justificación y representa su límite. Se defiende que la no proposicional también tiene valor cognitivo, porque constituye una suerte de elección epistémica preteórica que no es exclusiva de la fe religiosa. Se explora la noción de ambigüedad religiosa, tanto a nivel intelectual como experiencial, y se sostiene que la relación entre la dimensión proposicional y la no-proposicional (...) de la fe está mediada por la función directiva de las presuposiciones metafísicas instauradas por la experiencia religiosa. A recent quarrel over faultless disagreements assumes that disputes over evaluative sentences should be understood as regular, factual disagreements. Instead, I propose that evaluative disagreements should be understood in Lewisian terms. Language use works like a rule-governed game. In it, the assertion of an evaluative sentence is an attempt to establish one value as default in the conversation; its rejection, in turn, is in most cases the refusal to accept this move.

This paper argues that the historical character of our knowledge is compatible with both ontological and epistemological realism. The first part critically analyses the thesis according to which the situated nature of our cognitive practices implies that they do not refer to an extra-linguistic reality. The second section explores the claim that realism is a necessary presupposition of our communicative practices and the final part outlines the principles of a pluralist realism.

Maqasid al-Shariah based Islamic bioethics is an Islamic bioethics concept which uses the objectives of the Shariah as its approach in analysing and assessing bioethical issues. Analysis based on maqasid al-Shariah based Islamic bioethics will examine any bioethical issues from three main aspects namely intention, method, and output or final goal of the studied issues. Then, the evaluation will be analysed from human interest hierarchy, inclusivity, and degree of certainty. The Islamic bioethics concept is a manifestation of dynamic Islamic jurisprudence (...) which can overcome new complex and complicated bioethical issues such as tri-parent baby technology issues. Therefore, this article will introduce and explain the concept of maqasid al-Shariah based Islamic bioethics and outline a general guidance of maqasid al-Shariah based Islamic bioethics to determine a maqṣad based on standards of human good or well-being and harm. In view of the question regarding whether post- secularization entails the mutual exclusion of religion and rationality, it examines the proposals of J. Habermas and N. Wolterstorff, in a search for normative criteria for the dialogue between religious and non-religious rationalities. (shrink)

Christopher Hom has recently argued that the best-overall account of the meaning of pejorative terms is a semantic account according to which pejoratives make a distinctive truth-conditional contribution, and in particular express complex, negative socially constructed properties. In addition, Hom supplements the semantic account with a pragmatic strategy to deal with the derogatory content of occurrences of pejorative terms in negations, conditionals, attitude reports, and so on, according to which those occurrences give rise to conversational implicatures to the effect that (...) the pejorative terms are non-empty, which explains the offensiveness of those occurrences. In this paper, I aim to defend this semantic strategy from several recent objections, and I will also present a novel objection, which in my view shows that we should understand the semantic account as a version of inferentialism, rather than radical externalism. Despite the promises made by molecular evolutionists since the early 1960s that phylogenies would be readily reconstructed using molecular data, the construction of molecular phylogenies has both retained many methodological problems of the past and brought up new ones of considerable epistemic relevance. The field is driven not only by changes in knowledge about the processes of molecular evolution, but also by an ever-present methodological anxiety manifested in the constant search for an increased objectivity—or in its converse, the avoidance of (...) subjectivity.This paper offers an exhaustive account of the methodological and conceptual difficulties embedded in each of the steps required to elaborate molecular phytogenies. The authors adopt a historical perspective on the field in order to follow the development of practices that seek to increase the objectivity of their methods and representations. These include the adoption and development of explicit criteria for evaluation of evidence, and of procedures associated with methods of statistical inference, quantification and automation. All these are linked to an increasing use of computers in research since the mid 1960s. We will show that the practices of objectivity described are highly dependent on the problems and tools of molecular phylogenetics. (shrink)

It is almost a truism that political development is synonymous with the building of integrative institutions. The most important of these institutions is the political party. The political parties generally perform many manifest functions. Firstly, parties act as brokers of ideas, programmes and policies. In doing so, they articulate as well as aggregate the diverging interests of the country and help resolve cleavages within the nation. Secondly, they recruit support from all parts of the country and help elect political office-bear (...) ere. By developing machinery for the resolution of infra-party disputes, the parties help unite the people froth various regions from which they recruit their support arid develop a sense of identity among its supporters. She critical latent effect of these manifest functions of political parties is the creation of a high level of consensus and development and fostering of a national political culture. (shrink)

This article attempts to touch on the presence of anthropological approaches in contemporary readings of Islamic thought, given that the latter raises questions and problems that express events that are still characterised by a permanent and urgent situation, which led to the employment of several approaches and visions that descended from contemporary Western knowledge in the field of human sciences, including anthropology. Despite the Western origin of Islamic thought – anthropology – and the delay in its inclusion as a specialisation (...) within the field of academic practice in Arab universities after independence for various reasons, the years that followed the independence of Arab countries since the second half of the 20th century carried with them the seeds of the formation of the first anthropological research that began to find its way towards gradual maturity. Contribution: Anthropology, with its devised mechanisms and methodological tools, and the theoretical perceptions it entails, constitutes one of the entrances upon which contemporary readings of Islamic thought are based through a discussion of certain angles related to the historical and cultural heritage that furnish Islamic thought and nourish its references. Las Instituciones Nacionales de Derechos Humanos cumplen, fundamentalmente, con dos funciones: proteger a las personas a partir de recomendaciones, garantizándoles una reparación si se comente una violación a sus derechos, y prevenir futuras violaciones a los derechos humanos. Sobre esta base están llamadas a ser los organismos que guíen hacia una cultura ciudadana a favor de los derechos humanos. Para lograr la culturización en este campo, se requiere educar en derechos a través de la educación formal e informal. En el (...) caso de México, la Comisión Nacional de los Derechos Humanos es la institución encargada de realizar esta labor. Su posición flexible y dinámica, así como su autonomía dentro del Estado mexicano, le dan la posibilidad de propiciar esa cultura, ya que es una institución de configuración diferente al sistema tradicional de impartición de justicia, por lo que hace que mantenga una línea de investigación enfocada en los derechos humanos. La culturización empieza por el ámbito nacional o interno y se debe extender hacia el exterior, como un movimiento social internacional. (shrink)

Despite all its merits, the vast majority of critical attention devoted to colonialist literature restricts itself by severely bracketing the political context of culture and history. This typical facet of humanistic closure requires the critic systematically to avoid an analysis of the domination, manipulation, exploitation, and disfranchisement that are inevitably involved in the construction of any cultural artifact or relationship. I can best illustrate such closures in the field of colonialist discourse with two brief examples. In her book The Colonial (...) Encounter, which contrasts the colonial representations of three European and three non-European writers, M. M. Mahood skirts the political issue quite explicitly by arguing that she chose those authors precisely because they are “innocent of emotional exploitation of the colonial scene” and are “distanced” from the politics of domination.`1We find a more interesting example of this closure in Homi Bhabha’s criticism. While otherwise provocative and illuminating, his work rests on two assumptions—the unity of the “colonial subject” and the “ambivalence” of colonial discourse—that are inadequately problematized and, I feel, finally unwarranted and unacceptable. In rejecting Edward Said’s “suggestion that colonial power and discourse is possessed entirely by the colonizer,” Bhabha asserts, without providing any explanation, the unity of the “colonial subject .”2 I do not wish to rule out, a priori, the possibility that at some rarefied theoretical level the varied material and discursive antagonisms between conquerors and natives can be reduced to the workings of a single “subject”; but such a unity, let alone its value, must be demonstrated, not assumed. Though he cites Frantz Fanon, Bhabha completely ignored Fanon’s definition of the conqueror/native relation as a “Manichean” struggle—a definition that is not a fanciful metaphoric caricature but an accurate representation of a profound conflict.3 1. This study investigates the key factors that elicit financial reporting fraud among companies in Malaysia. Using enforcement action releases issued by the Security Commission of Malaysia and Bursa Malaysia, we identify a sample of 76 firms that had committed financial reporting fraud during the period of 1996–2016. We use the fraud triangle framework and the Malaysian International Standards on Auditing 240 to identify the factors. Since the simple probit model fails to address the identification problem, we estimate our results using (...) a bivariate probit model. The new model estimates the effects of pressure, opportunity, and rationalization on the probability of fraud likelihood by disentangling the detection probability of fraud. Among several proxies used for pressure, our results suggest that aggressive tax reporting and financial difficulties increase the likelihood of fraud commission. In regard to opportunity, we find that dedicated institutional investors, independence of the board, effective audit committee, and the presence of a female on the board provide active monitoring and oversight in reducing fraud occurrence. Results for rationalization suggest that prior violations and frequent changes of external auditors increase the chances of fraud occurrence. This research offers possible insights to auditors, managers, and regulators to prevent, detect, and react to fraud. Specifically, it highlights the specific factors that may exacerbate the fraudulent intentions of firms. (shrink)
